Understanding Lemon Law for Jeep Vehicles

Jeep is an iconic American brand of vehicle that has seen consistent popularity for decades. Ranked as America's most patriotic brand in the Brand Keys Most Patriotic Brands survey, Jeep sells thousands of vehicles every year. Although the bar for standards is high, not all Jeeps meet the mark.

Michigan and Ohio have strict laws that are designed to protect consumers if a newly purchased Jeep turns out to be a lemon. Lemon law typically applies to all new Jeep models, including but not limited to:

  • Jeep Wrangler

  • Jeep Cherokee

  • Jeep Grand Cherokee

  • Jeep Compass

  • Jeep Gladiator

  • Jeep Wagoneer

  • Jeep Grand Wagoneer

  • Jeep Renegade

Under both Michigan and Ohio lemon laws, you may be entitled to compensation, a repurchase of your vehicle or a replacement if your Jeep qualifies as a lemon. However, it's important to note that only vehicles covered by the original manufacturer's warranty can qualify. Used or older Jeeps typically do not qualify for legal recourse under lemon law, even if defects arise during the warranty period.  It is important to discuss the facts specific to your situation with an attorney experienced in the intricacies of these cases.

What Defines a “Lemon”?

Generally, a lemon is defined as a vehicle with persistent defects or problems that substantially impair its functionality, safety, or resale value and remain unresolved despite a reasonable number of repair attempts. For a Jeep to qualify as a lemon, generally, the car must:

  • Have a significant defect that is covered by the warranty that occurred within a specific period or after a number of miles traveled, and

  • Have a substantial defect that can't be fixed after a reasonable number of repair attempts, or

  • Have spent 30 days or more at the dealership for repairs within the first year of purchase.

Additionally, under Ohio law, your vehicle may qualify if it undergoes eight or more repair attempts for different issues or one attempt to repair a defect that is likely to cause death or serious injury. For example, if you purchased a 2023 Jeep Wrangler and the engine repeatedly stalls, misfires, or fails to start, and the dealership cannot fix the issue after multiple visits, it may qualify as a lemon.

Common Problems in Jeep Lemons

While it may not always be easy to identify whether your Jeep is a lemon, there are several common issues that might be a sign of a defective vehicle. These issues include:

  • Engine problems: Stalling, misfiring, excessive oil consumption, or failure to start.

  • Transmission issues: Rough shifting, transmission slipping, or complete transmission failure.

  • Electrical system defects: Problems with power windows, locks, dashboard displays, or infotainment systems.

  • Suspension and steering issues: Excessive vibration, alignment problems, or steering instability.

  • Brake system failures: Grinding, squealing, or diminished braking performance.

  • Water leaks and interior damage: Roof or door leaks causing water damage or mold.

  • Defective airbags or seat belts: Safety system malfunctions that compromise the well-being of drivers and passengers.

  • Defective batteries or charging systems: Trouble charging a vehicle or holding a charge.

If your Jeep is experiencing any of these defects, even if the dealership claims your vehicle is repaired or says there’s nothing wrong, persistent issues could mean your Jeep qualifies as a lemon. At Ronald S. Weiss, Attorney & Counselor, we can evaluate your case to determine whether your Jeep is a lemon and guide you through presenting a lemon law claim.

Potential Compensation for Jeep Lemons

If your Jeep qualifies as a lemon, you have two main options for compensation: a vehicle buyback or a replacement vehicle. The option you choose will largely depend on your preferences and situation.

  • Vehicle buyback: If your Jeep qualifies as a lemon, you may be eligible for a full refund, including the purchase price, taxes, and registration fees.

  • Replacement vehicle: If a vehicle buyback isn't a suitable option, you may be able to get a comparable vehicle as a replacement.

In some cases, the manufacturer might offer a cash settlement, allowing you to keep the vehicle. Whether you accept will depend on the facts of your case, your needs and the financial circumstances. Under Michigan and Ohio lemon laws, manufacturers must also cover your legal fees, so you can take legal action for a lemon without worrying about attorney costs.
